1. Acceptance of Agreement: This Agreement constitutes the terms and conditions of sale (the “Agreement”) between you, the buyer (hereinafter referred to as “you”) and HushHush., (hereinafter referred to as “we” or “us”). By placing an order for products from this website, you agree to be bound by and accept this Agreement.
2. Prices and Payment Terms: All prices are in Euros and are exclusive of applicable taxes. We reserve the right to change prices at any time. Payment by bank transfer, crypto transfer, credit card, or other acceptable forms of payment must be received prior to our acceptance of an order. You represent and warrant that you are authorized to use the chosen form of payment and that any and all information that you provide is true, correct and complete.
3. Shipping and Delivery: We will make every effort to ship products within 3 business days after receipt of payment. We cannot guarantee the exact time that it will take for the shipment to reach its destination. We are not responsible for delays due to weather, transportation, or other factors beyond our control.
4. Risk of Loss: The risk of loss and title passes to you upon delivery of the product to the carrier.
5. Warranty of Product: We warrant that the product purchased will be free from defects in materials and workmanship for a period of 14 days from the date of purchase. If the product is found to be defective, we will repair or replace the product at our discretion. This warranty does not cover damage caused by misuse, abuse, or improper care.
6. Use of product: The product purchased is not for human consumption and no health and wellness claims are made. We are not responsible for any misuse or abuse of the product.
7. Force Majeure: We shall not be liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including, but not limited to, acts of God, fire, explosion, vandalism, storm or other similar occurrence, power failure, equipment failure, industrial or labor dispute, war, acts of terrorism, civil disturbance, interruption of transportation, or any law, order, proclamation, regulation, ordinance, demand or requirement of any government or legal body.
8. Returns and Refunds: We accept returns within 14 days of purchase if the product is defective or unopened in its original packaging. We will not accept any return without prior written authorization. Shipping and handling fees are non-refundable. You are responsible for shipping costs associated with any returns. Refunds will be issued within 7 days of the return of the product and will be returned via the same payment method used for the purchase.
9. Limitation of Liability: In no event shall we be liable for any damages, including without limitation, direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this Agreement or the use of or inability to use the product purchased, even if we have been advised of the possibility of such damages.
10. Jurisdiction and Venue: This Agreement and any disputes arising under or related to this Agreement shall be governed by and construed in accordance with the laws of The Netherlands, without giving effect to its conflict of law provisions. You hereby consent to the exclusive jurisdiction and venue of the courts of The Netherlands in all disputes arising out of or relating to this Agreement.
11. Termination: We may terminate this Agreement at any time without notice to you in our sole discretion. Upon such termination, you must cease all use of the product purchased.
12. Entire Agreement: This Agreement constitutes the entire Agreement between you and us and supersedes all prior agreements and understandings, whether written or oral.
